Sunshine Cruz accuses Cesar Montano of marital rape

(UPDATE) Sunshine Cruz and Cesar Montano’s marital problems are taking a turn for the worse.

Sunshine formally filed a complaint against Cesar for alleged violation of Republic Act 9262, also known as Anti-violence Against Women and their Children, at the office of the city prosecutor on Tuesday, August 13.

According to the submitted affidavit, Cesar "violently attacked her, employed physical violence, and raped the complainant." The incident allegedly happened on Mother's Day, May 12, 2013, where Cesar "barged into complainant's residence."

The sworn statement also stated that Cesar's supposed "philandering and womanizing activities" led to the fallout of Sunshine's marriage to the actor. Furthermore, the actor allegedly continues to harass Sunshine by "threatening her with physical harm, obscene accusations and grave defamations."

Sunshine's legal counsel Atty. Bonifacio Alentajan, also said his client experienced "psychological, emotional, financial" abuse.

"Before that meron nang mga nangyayari, pero bilang tatay siya ng mga anak ko, as much as possible you want to protect the person," Sunshine told reporters.

The turning point

Sunshine explained that she filed a complaint against Cesar because she hasn't seen her children since July 29.

"Hindi ko na nakita ang mga anak ko. Hindi ko alam kung bakit ganoon. That's why I decided to do this already. I just want to see my children and yung karapatan ko bilang babae, masyado na tayong natatapakan."

She admits that she allows her daughters to stay with Cesar if she has showbiz commitments. But she was allegedly denied this right when she instructed her driver to pick up the children in Cesar's house.

"Simula nung naghiwalay kami, I don't go to that house anymore. My kids are telling me to pick them up because they miss me already. They wanna go home, so pinakuha ko sa driver. But I wasn't allowed, hindi sila pinalabas ng bahay. Kasi kapag nasa work naman ako, hinahayaan ko na kunin niya ang mga bata. Pero hindi na niya isinauli. Puro tomorrow, tomorrow. Sabi ng mga bata kapag tinatanong ko, 'When are you coming home?' 'Daddy said tomorrow.' Yung tomorrow na iyon, tumagal nang tumagal. Hanggang sa I realized he's not going to give back my kids," she said.

Longing for her children

Sunshine feels hurt and disappointed to have been deprived custody of her children.

"Mawala na ang lahat huwag lang ang anak ko. Napakasakit sa akin kasi I have been a devoted wife and devoted mother to my children. Sinakripisyo ko nga ang lahat para maalagaan ko ng mabuti ang mga anak ko. Tapos parang pusa ka na lang na tinanggalan ka nga mga kuting. So, masakit na masakit yung mga nangyari."
 
Is she  willing to settle the issue with Cesar if he returns the children to her?

"I don't know, I don't know with my lawyer. Siguro we have to talk about it. Ang importante sa akin ngayon, makita ko ang mga anak ko."
 
Alentajan says the petition for Temporary Protection Order he filed against Cesar in Sunshine’s behalf will be heard on August 15.
 
"Nasa batas iyan eh, at least 300 meters away. Hindi siya pwedeng lumapit. Nakalagay doon eh, yung denial of custody or access to the minor children is a crime."

Sunshine has returned to showbiz full-time after being away for many years because she wants to provide for herself and her children’s future.

As of this posting, Yahoo! Philippines OMG! is still waiting for Cesar Montano's statement on the case.
